Accretion of The Expert’s Power in Pretrial Proceedings as a Prerequisite for Improvement in Quality of Crime Investigation Procedure

Abstract


The paper emulates the national historical experience and current state of legislative regulation for attracting a specialist to assist the investigator in investigation procedure, as well as reveals the data derived from the investigators’ interviews, on account of which the authors come to conclusion about essentiality of accretion of the expert’s power in terms of assisting the investigator in conducting investigative actions, including interrogation, aimed at receiving evidence. In this regard, proposals have been made to change the wording of Articles 38 and 58 of the Russian Federation Code of Criminal Procedure. The proposed changes will significantly expand the expert’s power in all the investigative proceedings, verbal among others, and will correspond to recent trends in the development of criminal justice, improving its quality by attracting special knowledge and skills from various areas of human activity
